Membership Agreement:
Terms of Membership Agreement between WorldLinc Corp and the User.
This agreement supersede any other agreements you have with
WorldLinc Corp. WorldLinc
Corp agrees to provide and User agrees to receive access to service according to the following terms and conditions:
GENERAL:
1. Subject to the terms of the preceding paragraphs, this contract shall remain in effect for as long as User agrees to accept services from WorldLinc
Corp. All provisions herein apply to the User and all representatives of User which are billed in association with the User's primary account.
2. All provisions of this agreement apply to the User's Primary Account and to all Associated Accounts billed to the Primary Account, or Primary Account holder.
3. User is responsible for all hardware and software necessary to connect to provide
service, unless otherwise stated in
agreement.
4. User agrees to use the service in a manner consistent with any and all applicable laws.
5. All accounts are due on Expiration or Due date. If payment is not received by the due date, your account will be automatically suspended and a $10 reconnection fee will be applied. If your payment history is not satisfactory to WorldLinc
Corp we would require you to give us either a credit card # or sign up automatic payment for your internet fee. If your due date falls on the weekend, and payment is not received by noon of the next business day, your account will be suspended. A $30 fee will be applied to all returned check payments from the bank.
BILLING
1. User is responsible for any applicable long-distance telephone charges for connecting directly to WorldLinc.
2. User agrees to pay WorldLinc all charges relating to the use of User's account (s) according to rates and prices published on-line at the time the service is used. On-line rates and pricing are incorporated into this Agreement by reference.
3. WorldLinc Corp reserves the right to charge 1.5% compounding late fee and/or collection expenses.
4. If your account is suspended due to non-payment, you will be charged a $10.00 reconnection fee.
5. WorldLinc Corp., reserves the right to suspend access to service for User account(s) upon an indication of credit problems including delinquent payments or rejection of payment by credit card companies.
6. The client is responsible for all the usage fees, even in the
event WorldLinc failed to send the statement or bills on time.
The client will be responsibled for all overdue fees, legal
fees, and reconnect fees. The client will be billed based on
initial contracted rates.
OWNERSHIP/COPYRIGHT
1. Information available on WorldLinc is property of WorldLinc Corp., or its information providers. User shall not redistribute or commercially exploit such information without the express written permission of its owner(s).
2. Information providers have the right to assert and enforce copyright provisions directly on their own behalf.
3. User submitting information for publication on WorldLinc grants WorldLinc
Corp the nonexclusive permission to distribute the information product worldwide. User retains all rights.
LIMITATIONS OF LIABILITY
1. WorldLinc Corp., service is provided on an "as is, as available" basis, no warranties, expressed or implied, including but not limited to those of merchantability or fitness for a particular purpose are made with respect to informative or any information or software therein. We do not guarantee any upload or download speed.
2. Neither WorldLinc Corp or its information providers are responsible for any damage arising from Users use on WorldLinc internet or by User's inability to use said services.
3. WorldLinc Corp is not responsible for User's personal information residing on the server.
4. WorldLinc Corp is not liable for any lost revenue or expense incurred to user while hosting a domain website or using our internet services.
5. WorldLinc Corp will, from time to time, perform equipment or software maintenance as required, which may result in a loss of Internet service to User.
6. Mail program support: We only support webmail supplied by
WorldLinc Corp. We do not support Outlook Express or any other
mail software. Our office hours: Monday to Friday 8.30am to 3.30
pm. Support email anytime 24x7.
OPERATION
1. WorldLinc Corp reserves the right to change, without notice, the WorldLinc service, including but not limited to access procedures, hours of operation, menu structure, command, documentation, and services offered.
2. WorldLinc Corp reserves the right, at its sole discretion, to delete any information entered onto WorldLinc by User. WorldLinc
Corp and/or its authorized representative has the right, but should not be obligated to, edit public information.
3. User hereby agrees that any material submitted for publication on WorldLinc, through User's account(s), does not violate or infringe on any copyrights, trademarks, patents, any statutes, common law, proprietary rights of others, or contain anything obscene or libelous.
4. WorldLinc Corp at its sole business judgment, may terminate this Agreement and suspend access to User's account(s) upon any breach of this agreement, including, but not limited to, refusal or failure to pay for services provided.
5. Use of distribution rights in electronic mail or other mass electronic mailing is subject to approval by WorldLinc membership services.
6. This Agreement shall be governed by the laws of the State of Kansas. Any claims or causes of action related to WorldLinc
Corp must be instituted within one (1) year.
7. WorldLinc Corp may modify these terms and conditions upon notice published on-line via WorldLinc
Corp User's use of WorldLinc after such notices shall conform to all changes of Agreement's new terms and conditions.
8. User is responsible for the confidentiality of their user (login) name and password.
9. Unlimited dialup Internet access is provided and is defined as User attended Internet usage. Simultaneous logins are not allowed on our server. WorldLinc
Corp at its sole discretion, terminate any account found to be in violation of the of the unlimited usage policy.
10. Unlimited dialup Internet access is further defined as access that is unmetered and not subject to overage fees or monthly usage caps. WorldLinc unlimited dialup Internet access is not dedicated access. We have a session limit of 3 hours and idle time of 15 minutes.
11. All emails stored on the servers that are more than 30 days old will deleted from the server automatically.
12. We provide customized spam-filtered for your email boxes.

* If any one or more paragraphs in this Agreement is found to be unenforceable or invalid, User's and WorldLinc agreement on all other paragraphs is not affected.
CANCELLATION: Must be submitted to WorldLinc Corp in writing. No refunds will be given for unused terms of service if you wish to cancel before your renewal date. |
